Whispr Journal helps you record and revisit personal reflections. These Terms explain the service, your content rights, Premium purchases and its limitations. Please read them before using the App.
1. Agreement, operator and eligibility
These Terms govern Whispr Journal (the “App”), operated by Oğuz Tonyalı (“we,” “us,” or “our”). They supplement the Apple Standard Licensed Application End User License Agreement and applicable App Store terms; they do not reduce rights those terms or mandatory law give you. Use the App only if you can lawfully agree to these Terms, or with the parent/guardian permission required where you live. The App is not intended for children under 13.
2. What the App provides
Whispr Journal is a personal journaling tool for typed and dictated entries, local search, different reading modes and themes, and optional moods, tags, favorites, journal-calendar browsing, text sharing and Journal Lock. It requires a supported iPhone and iOS version. Some features require Premium, hardware support, device settings, permissions or internet access.
3. Personal reflection, not healthcare
The App is not a therapist, medical device, diagnostic service or emergency service. Moods and journal dates are personal organizational features, not clinical assessments. We do not monitor your entries for distress or provide crisis intervention, and no medical or mental-health outcome is promised. Seek qualified care for health concerns; if you or someone else is in immediate danger, contact local emergency services.
4. Your content and responsibilities
You retain your rights in entries you create. Writing in the App does not transfer ownership of your journal to us or authorize us to publish it. You are responsible for what you write, dictate and share, and for respecting other people’s privacy and rights. The App processes your content only as needed for the features you choose, as described in the Privacy Policy.
Review speech-to-text output before saving or relying on it. Recognition can omit words, introduce mistakes or misinterpret names, dates and meaning. The App is not a certified transcript or official record system.
5. Dictation and permissions
Voice input uses Apple Speech Recognition and requires microphone and speech permission. On-device recognition is requested when supported; otherwise audio may be sent to Apple for recognition. Availability and accuracy vary by language, device, network and Apple service status. “Unlimited” Premium voice access removes the App’s free-session quota; it does not override Apple’s technical limits or guarantee uninterrupted recognition.
Only dictate content you are entitled to provide. Obtain any consent required before capturing another person’s speech. You can stop a session, decline permission and type instead.
6. Journal Lock, local storage and backups
Journal Lock uses Apple device authentication, including a device-passcode fallback where offered. It is an access-control feature, not a guarantee of confidentiality against every person or system with device access, and not a separate end-to-end encrypted vault. You remain responsible for device security, your passcode, backups and copies of entries.
The App does not offer its own account-based journal backup or synchronization service. Data can be lost after deletion, device loss, damage, storage failure or reinstalling. We cannot recover local entries we do not possess. Maintain appropriate copies of important content and review your Apple backup settings.
7. Free features and Premium
The App includes free journaling features and a limited number of free voice sessions. Whispr Premium may unlock additional voice access, moods, tags, favorites, journal-calendar access, text export and Journal Lock. The current available features and limits are shown in the App. Features may evolve, but mandatory consumer rights and commitments made at purchase remain protected.
8. Subscriptions and billing
Premium may be offered as weekly and yearly auto-renewable subscriptions. Apple’s purchase confirmation shows the actual localized price, duration and any offer before you commit. Payment is charged to your Apple Account on confirmation, or after an eligible free trial.
Subscriptions renew unless canceled through your Apple Account subscription settings. Cancel at least 24 hours before the current period ends to avoid renewal; renewal may be charged within the preceding 24 hours. Deleting the App, deleting entries or disabling permissions does not cancel billing. Access normally continues to the end of the paid period after cancellation, subject to Apple’s rules and any refund.
9. Trials and lifetime access
A yearly plan may include a three-day free trial only if Apple shows that offer and confirms eligibility. Unless canceled in time, it converts to the paid plan shown at purchase. Apple recommends canceling a free or discounted trial at least 24 hours before it ends if you do not wish to renew.
A lifetime plan, when offered, is a one-time non-consumable purchase, not a renewing subscription. It provides the purchased Premium entitlement for the supported lifetime of Whispr Journal; it is not a promise that the App, every feature or third-party service will operate forever or on every future device. Applicable consumer guarantees still apply.
10. Restoration and refunds
Use “Restore Purchases” in the App with the Apple Account used to buy eligible access. Apple handles App Store payment and refund requests under its policies and applicable law. RevenueCat manages the App’s purchase entitlement. We can help investigate access issues but do not directly charge your card or issue App Store refunds. Restoring a purchase restores eligible access, not deleted journal entries.
11. Sharing and third-party services
Text export includes the selected entry’s title, body and date through the iOS share sheet. Check both the content and recipient before sharing. Copies held by another app, recipient or cloud service are outside Journal Lock and subject to that provider’s terms.
Apple provides distribution, billing, speech recognition and device authentication, while RevenueCat supports purchases. Third-party outages or account restrictions may affect these features. See the Apple Standard EULA and RevenueCat Terms for provider information.
12. License and acceptable use
You receive a limited, non-exclusive license to use the App on Apple devices you own or control as permitted by Apple’s Usage Rules. We and our licensors retain rights in the App’s code, branding, artwork and interfaces, separate from your journal content.
Do not bypass payments or security, redistribute the App without permission, infringe others’ rights, misuse dictation for unlawful recording, or interfere with Apple, RevenueCat or the App. Reverse engineering and copying restrictions apply only to the extent permitted by law and relevant open-source licenses.
13. Availability, warranties and liability
We may maintain, update or change the App for technical, legal, security or business reasons. We do not promise uninterrupted service, error-free transcription, perpetual third-party support, or preservation of local data. To the extent permitted by law, the App is supplied “as is” and “as available,” and we are not liable for indirect or consequential losses arising from its use, such as loss of data or opportunity.
Nothing excludes or limits non-waivable consumer rights, liability for fraud or wilful misconduct, or any liability that applicable law forbids us to exclude or limit. Paid-access changes remain subject to applicable notice, remedy and refund rights.
14. Ending use and changes to these Terms
You may stop using the App at any time and cancel subscriptions separately through Apple. A material breach may end your license to use the App, subject to applicable law. We may revise these Terms as features or legal requirements change and will communicate material changes as required. Changes do not retroactively remove rights you have already acquired.
15. Governing law and contact
These supplemental Terms are governed by the laws of Türkiye to the extent permitted by applicable law. Mandatory consumer protections and any non-waivable jurisdiction or governing-law rights in your country continue to apply; Apple’s own agreements remain separately applicable.
